Zaglin Withdraws Motion For New Trial

As highlighted in this prior post, in September 2025 a jury found Carl Zaglin guilty of FCPA and related offenses for his role in bribery schemes involving Honduran government officials to secure contracts to provide uniforms and other goods to the Honduran National Police.
In December 2025, Zaglin was sentenced to 8 years in prison. (See here).
Shortly thereafter, Zaglin filed a Second Motion for a New Trial asserting that a co-Defendant – Aldo Nestor Marchena (Marchena) – testified falsely against him in his trial. In connection with the same core action, Marchena had previosuly pleaded guilty and following the Zaglin trial, the DOJ filed a motion for departure seeking a 40% reduction in Marchena’s sentence for providing substantial cooperation.

An interesting sequence of events.

Zaglin Sentenced To 8 Years

Individuals charged with Foreign Corrupt Practices Act violations (or most other criminal violations) face a stark choice.
Test your innocence or plead guilty – often while cooperating.
Obviously, the alleged facts and legal theories involved are going to drive much of this analysis, but risk aversion often does as well.
If an individual tests his/her innocence and does not “pass the test,” the ultimate outcome is likely going to be much more harsh compared to other options.
This dynamic is part of the reason why there has only been approximately 25 FCPA trials in the FCPA’s nearly 50 year history.
Zaglin Found Guilty At Trial

In late 2023, the DOJ announced the unsealing of an indictment criminally charging: Carl Alan Zaglin (the owner of a Georgia-based manufacturer of law enforcement uniforms and accessories); Francisco Roberto Cosenza Centeno (former Executive Director of the Comité Técnico del Fideicomiso para la Administración del Fondo de Protección y Seguridad Poblacional (TASA) a Honduran governmental entity that procured goods for the Honduran National Police); and Aldo Nestor Marchena (a dual citizen of the U.S. and Peru) for their alleged participation in a scheme to pay and conceal bribes to Honduran government officials to secure contracts to provide uniforms and other goods to the Honduran National Police. Cosenza and Marchena previously pleaded guilty.
Last week, the Zaglin trial began in the S.D. of Florida (and is believed to be just the 24th FCPA jury trial in the FCPA’s nearly 48 years).
