FCPA Institute – Zoom (April 8-10)

Since 2014, the FCPA Institute has elevated the Foreign Corrupt Practices Act knowledge and practical skills of professionals from around the world. The FCPA Institute began as an in-person event, but shifted to Zoom in 2020. The Zoom event is time and cost efficient and has resulted in greater participation from professionals around the world.

The next FCPA Institute – Zoom will be offered on April 8-10 and consists of 9 hours of integrated and cohesive instruction (each day from 7:00 a.m. -10:00 a.m. U.S. central) led by Professor Koehler, an FCPA expert with FCPA practice and teaching experience.

FCPA Institute – Zoom participants will encounter FCPA authority and other sources of information that define the modern era of FCPA enforcement and will gain knowledge of the following topics among others:

WTH?

The credibility and persuasive of some commentators was diminished during the first Trump administration as their seeming disdain for one person (whether warranted or not is besides the point) impacted much of their commentary.

Some sit in front of a computer screen from their home offices with action figures in the background and give themselves and their friends cute nicknames.

But the rest of us are apparently supposed to listen.

So it begins again with the second Trump administration.

The Origins Of 2024 Corporate Enforcement Actions

This recent post compared corporate FCPA enforcement actions in 2024 to prior years.

However, before a Foreign Corrupt Practices Act enforcement action is announced, scrutiny must first arise.

In summary, of the eleven corporate enforcement actions from 2024, four enforcement actions (36%) originated with a voluntary disclosure (albeit in two instances the DOJ found the disclosures to be imperfect).

Jimmy Carter And The FCPA

Jimmy Carter, the 39th President of the United States, recently passed away.

President Carter signed the Foreign Corrupt Practices Act into law in December 1977.

As chronicled in “The Story of the FCPA,” in 1975 and 1976 Congress sought to address the so-called foreign corporate payments problem from a variety of angles. The Ford administration in 1976 favored a disclosure approach as to a broad category of payments. However, key congressional leaders favored a criminalization approach as to a narrow category of payments. 

Congressional efforts to address the problem paused for the 1976 elections in which the Democratic candidate Jimmy Carter defeated Republican President Ford.
